One mother, who is a self-proclaimed lesbian, has requested that the judge proceeding over her divorce case recuse himself. This isn’t the first time she has made this request. Earlier this year, she filed two motions asking for the recusal of the judge, but both times the judge denied her requests. After refusing multiple requests, the mother petitioned the Alabama Court of Civil Appeals.
The mother argues that the judge should not rule over her case because of his religion and public stances on homosexuality. The judge is well-known in his community as a fundamentalist preacher who has continued to preach even after taking his office as judge. During his campaign, he reinforced his opinions and noted he was a “conservative Baptist”. The judge has boldly noted that he strongly holds to the belief that same-sex marriages and relationships are against God’s law. The mother has vehemently expressed the opinion that the judge’s beliefs could potentially influence his decision in her divorce case. The judge will need to make child custody decisions, and the mother fears that her sexuality may influence the judge’s perception of her as a stable and fit parent.
The appeals court ultimately denied her requests. They determined that the judge had previously granted physical custody to mothers who were proclaimed lesbians in two different cases. They also noted that the judge had initially granted the mother joint custody, so his opinions on homosexuality were not negatively influencing the case.
