When Can Alabama Spousal Support and Child Custody Arrangements Be Modified?

In general, support and custody arrangements can be modified if there has been a significant change in your living situation. This could include a promotion or pay increase, an involuntary decrease in work hours or pay, or relocation.

If you are the noncustodial parent and your child support decree requires you pay your child’s college expenses, you may be able to have your agreement modified.

It’s important to continue paying your existing support obligations until they have been legally changed. You can be held in contempt for failing to pay support, even if you intend to have your financial obligations modified.

Any requirement or obligation you or your spouse has in the divorce decree can be enforced by the Judge. If you or your spouse fail or refuse to comply with the decree, you or your spouse may be held in contempt of court. Sanctions for contempt can include jail time or money judgments being awarded.

Always contact an attorney before deciding to violate the decree. You should also contact an attorney before involuntarily violating the decree to see if a modification could keep the contempt from occurring.
